May 2nd, 2024 the Center for Medicaid Studies (CMS) released a press release that said this, "DACA recipients will no longer be excluded from eligibility to enroll in a Qualified Health Plan (QHP) through the Affordable Care Act (ACA) Health Insurance Marketplace." A couple of key facts:
DACA recipients and other newly eligible individuals will qualify for a special enrollment period to select a health plan through the Marketplace during the 60 days following the rule’s November 1, 2024, effective date. This timing also corresponds with the 2025 Open Enrollment Period,
CMS also made technical modifications to the definition of “lawfully present” used to determine eligibility for coverage through a Marketplace or a BHP to promote administrative efficiency, clarity, and transparency.

If you expect to receive your application back during open enrollment, please apply on our survey below. Since the rule is relatively new, you must have identification information ready to supply to CMS to qualify and be enrolled.
All group employer plans must offer the Minimum Essential Coverage (MEC). This standard is the same for plans in the federal marketplace. But not all insurance offered by employers is deemed affordable by federal standards. If the cost of your insurance exceeds 9.02% of your pay then you can apply for ACA coverage.
Yes you can always apply! Outside of open enrollment you will need to qualify for a Special Enrollment Period (SEP). We will provide you a survey of questions to check your eligibility and if you qualify you have 30 days to supply documentation to CMS.
